The Investigative Committee of the Russian Federation, in the opinion of its head Alexander Bastrykin, will ask the deputies to recognize cryptocurrencies as property and develop a mechanism for their confiscation. Alexander Bastrykin said this in an interview he gave to Rossiyskaya Gazeta.
Recall that last year, the Prosecutor General of Russia, Igor Krasnov, notified that regulations were being prepared to recognize virtual currencies as the subject of criminal acts and confiscate them. Now the head of the Investigative Committee of the Russian Federation, A. Bastrykin, is talking about the same thing. He believes that now is the time to change the legislation and take appropriate measures.
Why exactly now the head of the Investigative Committee of the Russian Federation calls for the confiscation of cryptocurrencies
In an interview, he said that there are still gray areas in the legislation that are not properly regulated. If they are not regulated, then it is impossible to talk about effective counteraction to illegal transactions using virtual currencies.
So far, several legal acts have not been adopted in the Criminal Code of the Russian Federation, which would fix the belonging of cryptocurrencies to property. Since there are no such norms, it is extremely difficult to qualify criminal acts related to the financing of terrorism and the creation of financial schemes.
Cryptocurrencies are often used by scammers and do not have a procedural status, which prevents the investigation from seizing and confiscating them.
How the Investigative Committee of the Russian Federation plans to confiscate cryptocurrencies
The head of the Investigative Committee of the Russian Federation A. Bastrykin believes that the arrest of virtual assets can be implemented by analogy with the arrest of finances and securities. At the same time, he pointed out that one should take into account the fact that cryptocurrencies are not subject to the full control of the regulator. To solve this problem, it is proposed to make sure that a provision is introduced into the Criminal Code that would allow the court to force suspects to transfer cryptocurrencies to a special account until the investigation is completed.
With appropriate initiatives, the Investigative Committee will apply to the deputies of the State Duma of the Russian Federation so that they adopt the necessary norms into legislation.
